Terms of Service
1. Agreement to Terms
These Terms of Service (“Terms”) are a legal agreement between you and ALMA Games (“ALMA Games”, “we”) governing your access to and use of our mobile games, websites, and related services that link to these Terms (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Changes to the Terms
We may update these Terms from time to time. If changes are material, we will provide notice in the Services and/or on our websites before they take effect. Your continued use of the Services after changes become effective constitutes acceptance.
3. License and Use Restrictions
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial entertainment on authorized devices. You agree not to: (a) copy, modify, or create derivative works of the Services; (b) reverse engineer, decompile, or attempt to extract source code; (c) rent, lease, sell, sublicense, or otherwise transfer the Services; (d) use cheats, automation software, bots, mods, hacks, or any unauthorized third-party software; (e) interfere with or disrupt the Services or servers; (f) use the Services in violation of law or third-party rights.
4. Accounts and Eligibility
You may need an account to use parts of the Services. You are responsible for your account and for keeping your credentials secure. By using the Services, you represent that you are at least the age of majority in your jurisdiction, or you have reviewed these Terms with your parent/guardian and they agree to them on your behalf. Our Services are intended for a general audience and are not directed to children where parental consent is required; see our Privacy Policy.
5. In-App Purchases, Virtual Currency and Items
The Services may allow you to purchase virtual currency (“Virtual Currency”) and virtual items or content (“Virtual Items”). Virtual Currency and Virtual Items are licensed, not sold, have no real-world cash value, and cannot be exchanged outside the Services. All purchases are final and non-refundable except as required by the platform’s terms or applicable law. Platforms (e.g., Apple App Store, Google Play) process payments; please contact the relevant platform for billing issues.
We may change, suspend, or discontinue Virtual Currency or Virtual Items at any time, including their availability, pricing, and functionality. If your account is terminated or the Services are discontinued, your license to Virtual Currency and Virtual Items ends.
6. Advertising
Some Games are ad-supported. “Remove Ads” products disable interstitial ads (e.g., between levels). Optional rewarded ads may still be available for voluntary viewing to receive in-game rewards.
7. User Content and Conduct
You are responsible for any content you submit or make available through the Services (“User Content”). Do not submit content that is illegal, infringing, harmful, or violates these Terms. You grant ALMA Games a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, reproduce, distribute, display, and perform your User Content as necessary to operate and improve the Services.
8. Ownership
We and our licensors own all rights in the Services, including game software, artwork, music, and trademarks. Except for the license granted to you under Section 3, no rights are transferred to you.
9. Updates and Availability
We may provide patches, updates, or changes that you must install to continue using the Services. We do not guarantee continuous availability of any part of the Services.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALMA GAMES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS IN THE AGGREGATE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID (IF ANY) FOR THE SPECIFIC IN-APP PURCHASE GIVING RISE TO THE CLAIM, OR (B) USD $50.
12. Termination
We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or pose a risk to the Services or other users. You may stop using the Services at any time. Upon termination, the rights granted to you under these Terms will end.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws applicable in your place of residence, without regard to conflict-of-law rules. If you reside in the EU/UK, you may bring a claim in your local courts. Otherwise, where permitted by law, disputes will be resolved in the courts of your residence on an individual basis. Nothing limits your mandatory consumer rights.

15. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and ALMA Games regarding the Services. If any provision is found unenforceable, the remainder will stay in effect. You may not assign these Terms without our consent. We may transfer our rights and obligations under these Terms.
